On October 30, 2022, Regulatory Decree n.º 4/2022, of September 30, came into force, which amends Law n.º 23/2007, of July 4, which regulates the legal regime of entry , permanence, departure and removal of foreign citizens from the national territory.
This diploma allows the granting of temporary stay or residence visas to workers who intend to be in Portugal providing their work remotely to an employer that is not located in Portuguese national territory.
The temporary stay visa aims to grant entry and stay in Portugal for a period of one year to all those who carry out: “Exercising a subordinate or independent professional activity, provided remotely, to a natural or legal person with domicile or headquarters outside national territory”;
Indeed, in subordinate work situations, one of the following documents:
i) Employment contract;
ii) Promise of employment contract;
iii) Statement from the employer to prove the employment relationship;
In the case of the exercise of independent professional activity, one of the following documents:
i) Articles of Association;
ii) Service provision contract;
iii) Written proposal for a service provision contract;
iv) Demonstrative document of services provided to one or more entities;
In addition, the application for a temporary stay visa for the exercise of a professional activity provided remotely must be accompanied by a document proving the average monthly income earned in the exercise of a subordinate or independent professional activity in the last three months of a minimum amount equivalent to four guaranteed monthly minimum wages and also a document attesting to your tax residency.
Therefore, with the covid-19 pandemic, remote work has increased its expression at an international level, which, combined with a growth in activities that can be carried out remotely, leads the Portuguese State to create conditions for “digital nomads”, intending to simplify procedures for citizens of other countries who want to come to Portugal to carry out their activity remotely and, in return, benefit from attracting more human resources.
